Homicide is the taking of another person’s life.  Under Oklahoma law, there are variousdegrees of homicide with which an individual may be charged.  When one hears the term “homicide,” oneoften thinks of first-degree murder, the most serious of Oklahoma homicidecharges.  Murder in the firstdegree is the intentional, premeditated killing of another person.  First-degree murder charges can alsoresult from death by child abuse, unintentional murder during the commission ofa felony, or the killing of a law enforcement official performing his or her duties.  However, while the word “homicide”conjures images of deliberate murder, Oklahoma homicide law establishes chargesfor actions that result in the death of another.  The unlawful killing of another person without “maliceaforethought” is considered manslaughter.Oklahoma manslaughter can be voluntary or involuntary.  Voluntary manslaughter is an act ofmurder that occurs during a sudden quarrel or “in the heat of passion.”  Involuntary manslaughter occurs when adeath is the result of a negligent, reckless action or is caused by an illegalact that is not a felony.  Often, involuntary manslaughter charges stem from motor vehicleaccidents.  This type of manslaughteris frequently referred to as vehicular manslaughter.  Fatal reckless driving accidents and DUI collisions canresult in involuntary manslaughter charges for the individuals who caused theaccident.DUI manslaughter in Oklahoma is generally charged as first-degreemanslaughter.  According toOklahoma Statutes, first-degree manslaughter occurs:1.   Whenperpetrated without a design to effect death by a person while engaged in thecommission of a misdemeanor. 2.   Whenperpetrated without a design to effect death, and in a heat of passion, but ina cruel and unusual manner, or by means of a dangerous weapon; unless it iscommitted under such circumstances as constitute excusable or justifiablehomicide. 3.   Whenperpetrated unnecessarily either while resisting an attempt by the personkilled to commit a crime, or after such attempt shall have failed.
