In the case of imports from another EEA State, the distributor shall provide a copy of the notification of the concentration levels for heavy metals laid down in Directive 94/62 / EC of the European Parliament and of the Council under Article 5 of Commission Decision 2001/171 / EC.The results of the monitoring measurements referred to in paragraph 4 and the measurement methods used shall be made available to the environmental authority on request by the packaging manufacturer or, in the case of paragraph 6, by the first distributor.Section 4 (1) The manufacturer may apply an identification mark to the packaging material and to the way in which packaging waste is treated. If the manufacturer applies an identification mark, other than the identification mark required for packaging material, packaging waste treatment methodothermarkings as specified in separate legislation, he may only use the identification system and methods set out in Annex 2.Where the manufacturer affixes a label to the packaging or packaging, the identification shall be affixed to the packaging.(a) clearly visible,(b) lasting, and(c) be clearly legible after opening the packagemust be.(3) The manufacturer shall affix, in a clearly legible and legible manner, an identification marking of the heavy metal content to a pallet or pallet of heavy metal which has been repaired or recycled in accordance with Article 3 (1) and which contains heavy metal exceeding the limit specified in Article 3 (1), to make the marking permanent and inviolable.The manufacturer, the distributor of the packaging, shall ensure that the identification mark referred to in paragraph 3 is affixed to:(a) plastic crates and pallets for distribution, take - back, reuse;(b) plastic crates and pallets which have become packaging waste are recyclablea system in which recycled or recycled plastic crates and pallets have the longest useful life and at least 90% of the conditions of their remaining in the production-consumption chain.Article 5 (1) Only packaging which satisfies the essential requirements of Annex 3 may be placed on the market.(2) The essential requirements for the composition, reusability, and recoverability of packaging waste, including in its material, are set out in Annex 3.The application of the national standards for packaging set out in point 4 of Annex 3 shall be subject to the requirements set out in this Regulation, provided that the essential requirements are met.
