2011年土木硕士毕业，当时找了一个月不到就在就读大学的城市找到一份工作。公司没有帮忙办理工作签证。本来工作一直非常努力希望在PSW签证到期前转工签。结果因为公司出现财务问题，2013年12月份就遣散大部分员工了…并且公司已经申请破产了. 眼看近5个月工资没有拿到手，签证还有不到一个月到期，海投简历也没有回音。。。。难道只能回国了，有点不甘心。最最要命的是，不知道英国有没有破产保护政策，拖欠的工资还能要回来吗

我以前有个员工找一 xmas工作part time在一个商场里咖啡店当服务生也被拖欠了快1个月工资她就直接make formal complaint+跟经理提及辞职了

之前暑期有一个半月带薪假，就回国了，回去的时候那个月工资没发，想说回英国再一起拿。这就两个多月。然后之后老板开了支票但跳票了。。。他恳求我们员工通融，说很快发，这一拖又是两个月。。。前后加上差不多五个月

Hi there , I can’t type Chinese out here so please bear with me…
If the company you worked for has become insolvent and insolvency proceedings have been issued against it by its creditors there is nothing you can do about it as a current employee. HOWEVER , uk legislation says employees’ unpaid salary should be reimbursed from the company’s remaining assets before the creditors are paid . Therefore , there is still a high chance that you could recover most of your five month salary from the company or it’s administrator if the company has any assets , say buildings , equipments etc .
YOUR problem is your visa is due to expire by the end of this month. If so, you may not be able to wait until you are paid by the administrator before that time because insolvency proceeding usually takes a long time.
If I were you, I would try to instruct a English solicitor to do the legal workforce you while you are out of country and remit your salary , if any , to you after deducting his legal fees. I afraid this appears to be your only choice from the information I have seen so far.
