明天在和公司hr确认maternity leave的时分,有个疑难。

hr说休maternity leave的时分就可以不克不及休bank holiday了?是这样么?我记得是能够休的阿。

Holiday entitlement

You build up all your entitlements to paid holiday through all of your Statutory Maternity Leave. [/color]This is even if your employment contract says you are entitled to more than the statutory minimum.

You can add holiday to the beginning or end of your Statutory Maternity Leave. You may not be able to carry over untaken holiday entitlement if your Statutory Maternity Leave goes over two holiday years. It is often best to take this at the beginning of your Statutory Maternity Leave.

Does annual leave continue to accrue during maternity leave? What do we do about the fact that a woman may be on maternity leave during most of her annual leave year?

A. The Employment Rights Act provides that a woman is entitled to all her terms and conditions during both ordinary and additional maternity leave (OML and AML), apart from remuneration, as though she was at work, so she must accrue her leave, including bank holidays, throughout the whole of the maternity leave period. For those women employed under the Green Book, this has been the case for some time (see paragraph 十一.8(b) of Part 2 of the Green Book).

All our employees here are entitled to 25 days plus 8 statutory holidays, giving a total holiday entitlement to 33 days, which is in excess of the statutory minimum. The statutory minimum includes all holidays, regardless if they are denoted as standard or public holidays. So we aren’t doing you out of holidays – honestly!

I’ve checked out and indeed you are entitled to public holidays while on maternity leave. These will only affect the public holidays, which occur while you are off on maternity leave, so for you this will affect the December/Christmas and perhaps Easter 2013, depending on when you decide to return to work.

All these holidays can only be taken / paid out at the end of your maternity leave, when you are ready to come back to work as we have already discussed.

I recently talked with one of my friend who is taking Maternity leave at this moment, she passed me some information which is not same as we discussed. I did some research I think there is some misunderstandings regarding the public/bank holidays entitlement during maternity leave. I put this in writing as below to make the points more clear.

Please advise if I remembered correctly, I have been told that I was not entitled to accrue statutory (public/bank) holidays during maternity leave, but I am not sure why this is the case.

The Direct Gov website states “If your baby was due on or after 5 October 2008, you keep your normal employment rights and benefits (excluding wages) throughout your Statutory Maternity Leave (Ordinary and Additional Maternity Leave )”. It also specifies " You build up all your entitlements to paid holiday through all of your Statutory Maternity Leave. This is even if your employment contract says you are entitled to more than the statutory minimum. You can add holiday to the beginning or end of your Statutory Maternity Leave…"

As XXX Statements of terms and conditions of employment which I signed in 20XX, under HOLIDAY ENTITLEMENT section it states “the holiday year runs from January to December in one year, Employees joining the company accrue paid holiday entitlement…” and “in a full year, the paid holiday entitlement is x days plus y statutory days (I know the company changed the calculation method of holiday since last year, for example, in 20十二, the paid holiday entitlement is 175 hours plus 9 statutory days, new calculation doesn’t affect statement).” so I can’t see why the guidance above wouldn’t apply.

I called Directgot and Acas (Advisory, Conciliation and Arbitration Service), talked with Ms Bridgette Anderson and Mr. Nicolas Bell, I told them my situation and both of them gave me very affirmatory answers:

All workers have the right to have 28 days paid leave a year as this is the minimum statutory, if my holiday entitlements only for 25 days then company will be paying below the minimum start requirements.

During maternity I am entitled to build up all my paid holiday as I have the normal employment rights and benefits, I am protected to get all public holiday off and paid as same as my personal holiday.

Finally Nicolas said I can report this to Equalities and Human Rights Co妹妹ission, as he advised that I am a victim of direct sexual discrimination under the 1975 Sex Discrimination Act because I had “suffered a detriment that but for being on maternity leave would not have arisen”. Even I did not expect to get this information but you may need this for reference. 这段看你了,假如你说不出口就不要说。

I am not trying to be tricky, just want to clear up my mind and make sure I get the right information.

好繁杂,我也面临这个问题。咱们公司只付smp没有额定福利。
我想问,我当初去病院偶然要请半天到1天的假,这个是在我holiday里减去么?
还有,咱们是除去bank holiday,还有23天的待薪假期。这个23+bank holiday是曾经包罗在产假里,仍是能够加到产假上?
假如能够加到产假,我从下半年开始请产假,那年假是算半年的仍是整年的均可以加到产假?产假中的bank holiday和待薪假也能加到产假中么?
